Mandatory time recording for businesses in Spain

Every company in Spain must keep a daily time recording of its staff’s working hours: when each person starts and finishes. Gesthoras does it without paper or Excel sheets and keeps the records ready for the Spanish Labour Inspectorate.

The law

What Spanish law requires for time recording

Since May 2019, article 34.9 of the Workers’ Statute (Estatuto de los Trabajadores) has required every company, whatever its size or sector, to record the start and finish time of each employee’s working day, every day.

These working time records are kept for four years and must be available to the employee, their legal representatives and the Labour Inspectorate whenever they ask for them.

If you prefer paper, there is a printable timesheet template in PDF ready to use.

  • The record is daily: each person’s start and finish time.
  • It is kept for four years.
  • It must be available whenever staff, their representatives or the inspectorate ask for it.

Frequently asked questions

What people ask us most

Is recording working hours mandatory in Spain?

Yes. Since May 2019, article 34.9 of the Workers’ Statute (Estatuto de los Trabajadores) has required every company to record the start and finish time of each employee’s working day, every day.

How long must the records be kept?

Four years. During that time they must be available to the employee, their legal representatives and the Inspección de Trabajo (Spanish Labour Inspectorate) on request. Gesthoras keeps them and produces the reports for the inspectorate.

What happens if someone forgets to clock out?

The working day closes automatically at its assigned time, and that time can be changed.

Does Gesthoras track where each employee is?

Not throughout the day. It records where the working day starts and applies data minimisation: it collects only what the record needs, and geolocation is set up in a limited, justified way.
