Working time records apply whatever your size

Article 34.9 of the Workers’ Statute (Estatuto de los Trabajadores) requires every company with employees, whatever its size or sector, to record the start and finish time of each person’s working day, every day, and to keep those records for four years.

Failing to record working hours is a serious offence under Spain’s Law on Labour Offences and Penalties (Ley sobre Infracciones y Sanciones en el Orden Social, article 7.5), with fines of €751 to €7,500 per offence. In a small business with no HR department, the most practical approach is for each person to clock their own hours and for the company to have everything in one place.

• Self-employed with staff: you must record their working hours, like any other company.
• Self-employed with no employees: the record does not apply to you, because it is an obligation of the company towards its employees.
• Part-time contracts: hours are recorded day by day and totalled each month (article 12.4.c).

How much does time tracking cost for an SME?
